Background checks & your rights
Last reviewed: Draft, in progress
Selky runs a background check on every provider before their first job. The check is performed by Gonos, an FCRA-regulated consumer reporting agency. This page is a plain- English explainer of what's checked, how we use the result, and the rights you have under the federal Fair Credit Reporting Act (FCRA) and state law. The binding disclosure + written-consent language appears on Gonos's hosted signing page during provider signup — this page is a reference you can come back to any time.
1. What the check covers
Placeholder — will cover: Criminal records (federal, state, county) to the applicable FCRA lookback, SSN verification, sex-offender registry, OFAC / sanctions. Specifically does NOT include credit, employment history, or education.
2. Who runs the check
Placeholder — will cover: Gonos as the Consumer Reporting Agency (CRA), their role vs. Selky's, and the technical note that your SSN and identity info go directly to Gonos on their hosted page — Selky only receives the final pass/fail disposition.
3. Your written consent
Placeholder — will cover: FCRA requires written consent before a check runs. The binding consent document appears on Gonos's signing page; Selky stores only the audit trail (your IP address, user-agent, Gonos candidate id, and Gonos consent-session id) to show the consent happened.
4. How Selky uses the result
Placeholder — will cover: Clear → approved for jobs. Pending / consider dispositions → human adjudication against a written policy. Denied dispositions → adverse-action flow. Selky doesn't surface the underlying report content in the provider app or admin dashboard — only the top-line disposition.
5. If your check flags something
Placeholder — will cover: The FCRA pre-adverse-action process: Gonos emails + mails you the pre-notice, a copy of the report, and the Summary of Your Rights Under the FCRA. You get a 5-day dispute window handled on Gonos's hosted flow. If you don't dispute (or the dispute doesn't change the outcome), a final adverse-action notice follows and your Selky Pro account is deactivated.
6. Disputing an inaccurate report
Placeholder — will cover: You have the right to dispute inaccuracies directly with Gonos — contact info, response-time expectations, and what to do if Gonos's investigation upholds the result but you believe it's wrong.
7. State-specific rights
Placeholder — will cover: California, New York, Washington, and other states with additional notice / disclosure rules. These are enumerated here and the applicable state's language is surfaced during the Gonos consent flow based on your service address.
8. Summary of your rights under the FCRA
Placeholder — will cover: A link to the current CFPB-published Summary of Consumer Rights document (the mandated reference). Gonos delivers this document with the pre-adverse-action notice as required.
9. Contact
Placeholder — will cover: Gonos consumer-services contact for report disputes; Selky support for questions about how we use the disposition; Selky privacy contact for data-access requests about check-related records.
